Waterlogged Fishing Journal — Terms of Service

Effective date: August 1, 2026

Welcome to Waterlogged Fishing Journal. These Terms of Service (“Terms”) are a legal agreement between you and Christopher Kurtz (“Waterlogged,” “we,” “us”) governing your use of the Waterlogged app and website (the “Service”). By using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

1. Who can use Waterlogged

You must be at least 13 (or the minimum digital-consent age where you live) and able to form a binding contract. If you’re under the age of majority, use the Service only with a parent or guardian’s involvement.

2. The Service

Waterlogged helps you log fishing catches and view environmental conditions (weather, tides, water data) and historical pattern suggestions (“hotspots”). We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service for your own recreational fishing use, subject to these Terms.

3. Your account and keys

4. Your content

5. Acceptable use

You agree not to:

6. Subscriptions and payments

(Applies if/when paid plans are offered.)

7. Conditions data and third-party sources

Weather, tide, water-temperature, salinity, and regulatory information come from third-party public sources (e.g., Apple Weather, Open-Meteo, NOAA, USGS) and are provided “as is.” We don’t control and aren’t responsible for their accuracy, completeness, timeliness, or availability. Feature and data coverage varies by location — map overlays such as depth contours, fish attractors, and habitat layers depend on the data public agencies publish for each state or region, and some areas have limited or none.

8. Safety disclaimer — please read

Waterlogged is an informational and recreational tool, not a safety or navigation device. Conditions and forecasts may be inaccurate, delayed, or unavailable.

9. Disclaimers of warranties

The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don’t warrant that the Service will be uninterrupted, secure, or error-free.

10. Limitation of liability

To the fullest extent permitted by law, Waterlogged and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of (or inability to use) the Service — including any decision made on or near the water. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or US $50. Some jurisdictions don’t allow certain limitations, so parts of this may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Waterlogged and its operators from claims and expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time (Settings → Account → “Delete my account…”). We may suspend or terminate access if you violate these Terms or to protect the Service or other users. Provisions that by their nature should survive (content-license limits, disclaimers, liability limits) survive termination.

13. Changes

We may update the Service and these Terms. We’ll post updated Terms with a new effective date; material changes will be communicated in the app where appropriate. Continued use after changes means you accept them.

14. Governing law

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-laws rules. (You may add a dispute-resolution/arbitration clause after legal review.)
